1MD Nutrition® provides subscribers with the opportunity to consult with a Licensed Dietary Nutritionist (“LDN”). The purpose of the wellness consultation services is to provide guidance on how to use 1MD Nutrition® products (the “Services”). Services provided by LDNs as well as information on the 1MD Nutrition® website is not a replacement for professional medical advice. LDNs providing the Service are financially compensated by 1MD Nutrition®. This means that the LDNs involved in this Service are not independent third-party consultants; rather, they are directly employed by 1MD Nutrition®. By engaging with an LDN through your 1MD Nutrition® subscription, you hereby agree to the following terms:

Each of the LDNs engaged by 1MD Nutrition® hold a dietary nutritionist license in accordance with state and local law. However, all LDNs function exclusively as consultants and educators on behalf of 1MD Nutrition® and are not functioning in their professional capacity as licensed dietary nutritionists when providing the Services to you. This means the LDN cannot diagnose or treat any disease or medical condition, order laboratory tests or recommend or prescribe any medications. Further, you acknowledge that the LDN is not offering medical nutrition therapy nor telehealth services as defined by applicable state law. The information provided to you by the LDN is for informational purposes only and does not establish a provider-patient relationship nor is it intended or be construed as medical advice. Any recommendation, remedy or advice provided by an LDN, whether verbally or in writing, is not a substitute for the care of a physician or other qualified health care provider.

Although care has been taken in preparing the information provided to you, 1MD Nutrition® nor its LDNs cannot be held responsible for any errors or omissions, and we accept no liability whatsoever for any loss or damage you may incur. You understand and agree that you are fully responsible for your well-being during and following the Services, including your choices, decisions and actions. The Services and any information or advice provided are only recommendations, and you agree that any actions taken by you in reliance on any advice or information received from the LDN, and any consequences pursuant to such actions and decisions, are ultimately your own. You agree not to disregard, avoid or delay obtaining medical advice or treatment from a physician or other qualified healthcare provider because of any information you receive through your LDN consultation. You further agree to seek an opinion from a physician or other qualified health care provider if you have any current or future medical concerns.

LDNs may inquire about your health status and/or health history and provide general information and advice. LDNs make no guarantees or warranties of any kind, express or implied, about any results or outcomes to be achieved or services provided. 1MD Nutrition® makes no representation or warranty as to whether you will find LDN Services useful or satisfactory to your needs. You understand that all comments and ideas offered by the LDN are solely for the purpose of aiding you in achieving your goals when using 1MD Nutrition® products. You further understand that results are individual and may vary. By confirming you have read this document, you hereby give your consent to obtain the Services provided by 1MD Nutrition® in accordance with the terms and conditions set forth above.

I hereby release, waive, acquit and forever discharge 1MD Nutrition®, its LDNs, any agents, successors, assigns, personal representatives, executors, heirs and employees from every claim, suit, action, demand or right to compensation for damages I may claim to have or that I may have arising out of the acts or omissions by myself, 1MD Nutrition® or its LDNs as a result of advice or communication given from the Services. I further declare and represent that no promise, inducement or agreement not expressed in this agreement has been made to me to sign this document. This document is binding on my heirs, executors, personal representatives, successors, assigns and agents.

I understand that the availability of the Services is at the sole discretion of 1MD Nutrition®, and that 1MD Nutrition® reserves the right to terminate the program at any time. I further understand that while the program is operational, the Services will be available to me up to a maximum of 60 days from the time of the qualifying purchase.
